What is an LMIA?
A Labour Market Impact Assessment (LMIA) is a document Canadian employers may need before hiring a foreign worker. Must-have for the foreign worker to apply for their work permit.
It serves as proof that there is a need for a foreign worker to fill the job and that no Canadian worker is available to do the job.
An LMIA is issued by Employment and Social Development Canada (ESDC) and assesses the impact of hiring a foreign national on Canada's labour market.
LMIA Eligibility
To apply for an LMIA with ESDC, most Canadian employers must demonstrate their unsuccessful efforts in hiring local candidates.
Employers are required to provide evidence of advertising job offers for a minimum duration on various platforms, meeting standard requirements.
Complying with ESDC
- Unnamed LMIA or with pre-selected candidate's name
- Application fee: $1,000
- Processing time: 2 weeks to 3 months
- Employer interview: with ESDC officer
- Validity: 6 months in most cases
- LMIA result: positive, neutral or negative
- Work permit duration: up to 3 years
- Compliance inspections: possible after the foreign worker has been hired.
LMIA Exemption
In some circumstances, the LMIA will be exempt according to the IRPR and IRPA.
Applicable due to international agreements, Canadian interests, provincial/territorial immigration programs, permanent residence applicants, and specific IMP occupations or other situations.

STEP 1 - DETERMINE ELIGIBILITY

STEP 5 - APPROVAL LETTER

If approved, ESDC will send a confirmation letter (positive or neutral) outlining the terms and circumstances of the approved LMIA.

At this stage, the foreign worker can apply for a work permit from Immigration, Refugees, and Citizenship Canada (IRCC) with the LMIA approval letter.
